The Biometric Information Privacy Act
In recognizing the importance of the security of individuals’ biometrics, the Illinois Legislature enacted the Biometric Information Privacy Act (BIPA) in 2008. BIPA is designed to safeguard consumers’ personal biometric information by requiring private entities to obtain written consent from consumers prior to the collection of their private biometric information, inform consumers of the specific purpose for the collection of their private biometric information, and publish publicly available disclosures regarding the collection of such private biometric information.
McGuire attorneys recognize that as the number of data breaches increase, and hackers seek new ways to expose consumers’ personal biometric information, BIPA litigation and the protection of biometric information has become more important. Telephone Consumer Protection Act
Congress enacted the Telephone Consumer Protection Act in 1991 to address the increase in telephone marketing calls. The TCPA has been revised over the years to address evolving issues, such as automated text messaging, robocalls, autodialing, marketing calls to cellular telephones, Caller ID requirements for telephone marketers, and the establishment of a national do-not-call registry.
